1. About Cura Co

Cura Co is an independent referral and client-matching service that connects independent support workers with suitable participants.

Cura Co is not an employer, support provider, healthcare provider, care coordinator or participant representative unless otherwise stated.

Our role is to source, screen and introduce suitable participants and support workers. Following a successful introduction, all support services are delivered directly between the participant and the independent support worker.


2. Eligibility

To use Cura Co you must:

  • Be at least 18 years of age.
  • Be legally capable of entering into a binding agreement.
  • Provide accurate and truthful information.
  • Comply with all applicable Australian laws.

Support workers are responsible for maintaining all licences, qualifications, registrations, police checks, Working With Children Checks, NDIS Worker Screening Checks (where required), insurance and any other legal requirements applicable to their work.


3. Independent Contractor Relationship

Support workers introduced through Cura Co operate as independent contractors.

Nothing contained within these Terms creates an employment, agency, partnership or joint venture relationship between Cura Co and any support worker.

Support workers are solely responsible for:

  • Delivering support services.
  • Their own tax obligations.
  • Superannuation.
  • Insurance.
  • Business registrations.
  • Compliance with Australian law.
  • Compliance with any applicable NDIS requirements.

4. No Employment Relationship

Cura Co does not employ support workers.

Cura Co does not supervise, direct or manage the day-to-day delivery of care.

Participants and support workers enter into their own independent arrangements regarding services provided after an introduction.


5. Participant and Worker Responsibilities

Participants and support workers are solely responsible for:

  • Agreeing upon services.
  • Scheduling appointments.
  • Managing payments (where applicable).
  • Managing cancellations.
  • Service delivery.
  • Maintaining professional conduct.
  • Complying with applicable laws.

6. Membership Fees

Membership fees are payable as agreed between Cura Co and the support worker.

Membership fees are generally non-refundable unless otherwise required by Australian law.

Failure to pay membership fees may result in immediate suspension or termination of membership.


7. Minimum Hours Guarantee

Subject to the Support Worker:

  • Maintaining an active Cura Co membership;
  • Remaining available to accept suitable client placements;
  • Maintaining all required qualifications, registrations and insurance;
  • Complying with these Terms and any separate agreement with Cura Co;

Cura Co guarantees to secure a participant placement providing a minimum of eight (8) hours of work per week.

This guarantee does not apply where the Support Worker:

  • Declines suitable referrals.
  • Restricts their availability.
  • Becomes unavailable.
  • Fails to maintain legal or professional requirements.
  • Breaches these Terms.
  • Is unable to provide services due to illness, suspension or circumstances beyond Cura Co's reasonable control.

Where the guarantee applies and Cura Co is unable to provide a qualifying placement, Cura Co will use reasonable efforts to secure an alternative placement or provide another reasonable remedy at its discretion.


8. Protected Client Introductions

All participants introduced by Cura Co remain protected introductions of Cura Co.

Support workers agree they will not intentionally circumvent Cura Co by:

  • Cancelling their membership and continuing to work with a participant introduced by Cura Co.
  • Encouraging participants to cease their relationship with Cura Co.
  • Attempting to avoid membership fees through direct arrangements.

Unless otherwise agreed in writing, support workers must not provide services to participants introduced through Cura Co after cancelling their membership.

This restriction applies for a period of twelve (12) months following cancellation or termination.

Where this clause is breached, Cura Co reserves all legal rights available under Australian law, including seeking:

  • Injunctions.
  • Damages.
  • Recovery of lost revenue.
  • Legal costs.
  • Any other available remedies.

9. No Guarantee of Specific Clients

While Cura Co guarantees a qualifying placement in accordance with Section 7, Cura Co does not guarantee:

  • Specific participants.
  • Preferred locations.
  • Particular schedules.
  • Ongoing relationships with any individual participant.
  • Income above the guaranteed minimum placement.
  • Future referrals beyond those agreed.

10. Website Information

While Cura Co makes reasonable efforts to ensure all information is accurate, we make no warranties regarding the completeness, reliability or accuracy of information published on this website.


11. Limitation of Liability

To the fullest extent permitted by Australian law, Cura Co acts solely as an independent referral and matching service.

Cura Co is not responsible for:

  • Any injury, illness or death suffered by participants.
  • Any injury, illness or death suffered by support workers.
  • Property damage.
  • Financial loss.
  • Loss of earnings.
  • Negligence by participants.
  • Negligence by support workers.
  • Criminal conduct by participants or support workers.
  • Service quality.
  • Disputes between participants and support workers.
  • Cancellations.
  • Failure of either party to meet their contractual obligations.

Nothing in these Terms excludes rights that cannot legally be excluded under Australian Consumer Law or other applicable legislation.


12. Indemnity

You agree to indemnify and hold harmless Cura Co, its directors, employees, contractors and representatives from any claims, losses, damages, liabilities, legal expenses or proceedings arising from:

  • Your use of our services.
  • Your breach of these Terms.
  • Your negligence.
  • Your unlawful conduct.
  • Services you provide or receive through Cura Co.

13. Privacy

Cura Co collects, stores and uses personal information in accordance with our Privacy Policy.

By using our services, you consent to the collection and use of your information for the purposes of operating our referral and matching services.


14. Intellectual Property

All logos, branding, designs, website content, graphics, documents and intellectual property displayed on this website remain the property of Cura Co unless otherwise stated.

No content may be copied, reproduced, modified or distributed without prior written permission.


15. Suspension and Termination

Cura Co reserves the right to suspend or terminate memberships, referrals or access to its services where:

  • Membership fees remain unpaid.
  • These Terms are breached.
  • False information is provided.
  • Misconduct occurs.
  • There are legal or regulatory concerns.
  • Continued access presents an operational or reputational risk.

16. Changes to These Terms

Cura Co may amend these Terms at any time.

Updated Terms become effective immediately upon publication on this website.

Continued use of our services constitutes acceptance of the updated Terms.


17. Governing Law

These Terms are governed by the laws of Australia and the applicable State or Territory in which any dispute arises.
